Constitution of the Sabha
The Sabha is registered under Rajasthan Societies Registration Act
1958, No. 9/86-87.
1. Name of the Society: Mathur
Sabha, Jaipur
2. Registered office :
Registered Office of the Mathur Sabha, Jaipur
will be located in the city of Jaipur (Rajasthan) as determed by the
Executive Commitee.
3. Present Address (as of July 2007) : C/O General Secretary, Mathur Sabha, 4 LA 27, Jawahar Nagar, Jaipur.
4. Objectives of the Society
(i) To Promote cultural activities
(ii) To organise social gatherings for exchange of view.
(iii) To promote and encourage religious activities and arrange
lectures on religion,
(iv) To help economically poor, old and needy persons.
(v) To help ohter societies who work for the benefit of poor and needy
persons,
(vi) To encourage physical and sports activities in the community and
for that purpose ocasionally organise Indor and outdoor sports and
games and give prizes to the winners,
(vii) To encourage education in the community and where necessary
provide financial assistance to the brilliant and outstanding studnts
of the community.
(viii) To accept donations for achieving the aforesaid purposes.
5. Membership : Any member of
Mathur community who belives in achieving
the above objective of the Society is eligible to become member of the
Mathur Sabha, Jaipur
The Membership will be four type, viz, (i) Life Member, (ii) Annual
Member,(iii) Hon. Life Member and (iv) Donor Life Member
6. Membership Fee
Life Membership : Rs. 500/-
Annual Membership : Rs. 50/-
Hon. Life Membership : NRI (Donor)
Donor Life Member : Donor of Rs. 5000/- and above
7. Termination of Membership
(i) The membership will terminate in the
event of death. However, the spouse of the deceased will automatically
acquire Life Membership of the Sabha
(ii) The Membership can be terminated by the resolution of the
Executive Committee in the event of the Member working against the
interest of the Sabha.
(iii) Annual Membership ceases on 31st March every year.
8. General Body Meeting
The meeting of the General Body will be held
once a year. The date of the meeting will be announced atleast two
weeks in advance by the Executive committee. The meeting of the General
Body can also be called on any occassion if so demanded by two third
majority of the Members.
The quorum for the General Body meeting will be 50 or 1/3th of the
total Members, whichever is less.
If the General Body meeting is postponed for want of quorum, the next
date shall be fixed after a week. For this meeting, no quorum will be
required but the agenda shall remain the same.
9. Executive Committee
The committee of management will consist of
the following elected/nominated members.
1. President - one
2. Vice-President - one
3. General Secretary - one
4. Financial Secretary - one
5. Cultural Secretary - one
6. Executive Committee Members - at least one from each zone
During the Annual General meeting, the General Body will elect
President, General Secretary and Financial Secretary by consensus for a
period of three years, before the expiry of the term of the outgoing
Executive Committee. If it is not possible to elect the said office
bearers by consensus, they will be elected in the general body by
simple majority of the Members present in the meeting. The outgoing
Executive Committee will nominate a Returning Officer to conduct the
elections.
The President in consultation with the General Secretary is authorised
to nominate Vice-President, Cultural Secretary and atleast one.
Executive Committee Member from each zone in order to have better
representation of the Jaipur city, the number of Members may be
increased by the Executive Committee.
10. Powers of the General Body
General body meeting will be presided by the President and the General
Secretary will conduct the meeting and will present annual report and
budget for the approval of the general body.
The general body is fully empowered to amend the constitution by 1/3th
of the total strength of the Members or 50 Members, whichever is less.
11. Powers and Functions of the
executive Committee
(i) Carry out activities which are conducive in achieving the
objectives of the Mathur Sabha,
(ii) Formulate the Rules of Mathur Sabha for presentation and approval
of the General Body.
(iii) Prepare the Annual Budget and Statement of earning and expenses
for approval of the General Body.
(iv) Organise cultural programmes, sports, games and social gatherings.
(v) Replace by nomination any member of the Executive Committee who
remains absent in three consecutive meeting.
(vi) Safe guard the property of the Mathur Sabha.
(vii) Implement the resolutions passed by the General Body.
(viii) Take action for furtherance of the interest of the Mathur Sabha.
12. Executive Committee Meetings
The meeting of the Executive Committee will be held atleast four times
in a year to discuss the activities of the Sabha and related matters.
All the members shall be informed about a week in advance by the
General Secretary in consultation with the President.
The quorum of the meeting shall be 1/3th of the strength of the Members
of the Committee. If the meeting is postponed for want of the quorum,
the next meeting shall be fixed and no quorum shall be necessary but
the Agenda shall remain the same.
13. Powers and Functions of the Office
Bearers
I. PRESIDENT :
(a) To preside over the General Body and the Executive Committee
meetings.
(b) To take final decision in case of any dispute.
(c) In consultation with the General Secretary nominate 1
Vice-President, 1 Cultural Secretary and at least one Executive
Committee Member from each zone.
(d) To sign documents and papers.
(e) To call meetings.
(f) To represent Mathur Sabha, Jaipur or to nominate an office bearer
for the same.
(g) To authorise expenditure above Rs. 2000/- (Rs. Two Thousand), for
which the accounts shall be presented to the Executive Committee.
II. VICE-PRESIDENT :
In the absence of the President, the Vice-President will perform the
functions of the President and have the same powers as enjoyed by the
President.
III. GENERAL SECRETARY :
(a) Do all correspondence on behalf of the Mathur Sabha.
(b) Inform the President about the activities of the Sabha.
(c) Maintain and keep all the records of the Sabha.
(d) Send notices to call the meetings of the Executive Committee and
the General Body.
(e) Seek assistance on behalf of the Sabha and check accounts.
(f) Incur expenditure with the permission of the President. He will be
allowed to spend upto Rs. 2000/- (Rs. Two Thousand) at a time for which
the account will be presented to the Executive Committee.
(g) Put up the budget to the Executive Committee before presenting the
same to the General Body.
(h) To record the minutes of the Meeting.
(i) To control Income and Expenditure.
(j) To represent Mathur Sabha and sign.
(k) To safe guard the property of the Sabha.
(l) All other necessary work in the interest of the Sabha.
IV. FINANCIAL SECRETARY :
(a) In the absence of the General Secretary, the Financial Secretary will perform the functions of the General Secretary and execise the powers of the General Secretary.
(b) To keep the account of all the belongings of the Mathur Sabha.
(c) To collect membership fees, donations, and other contributions on behalf of the Mathur Sabha.
(d) Maintain and keep the account of the Mathur Sabha in such a manner as guided by the President.
(e) To pass valid and effective receipts on behalf of the Mathur Sabha for the amount received.
V. CULTURAL SECRETARY
To arrange Cultural activities during Holi, Diwali and other functions of the Mathur Sabha.
15. Previleges of the Members
Life Members and Donor Life members shall have the right to vote, nominate and stand for election of the Executive Committee. They shall also have the right to propose, second or support candidates for election to the Executive Committee.
Annual Members in 'good standing' i.e. those who have paid up all their dues to the Sabha in accordance with the Rules laid down, shall be entitled for the above privileges.
Honorary Life Members shall not have the above privileges. They shall however, be entitled to receive gratis, the Membership Direcotry and other Reports etc. circulated from time to time.
16. Bank Account
Bank account can be opened in any bank with the consent of the President, the General Secretary and the Financial Secretary according to the need of the Mathur Sabha. The account of the Mathur Sabha can be operated jointly by the President, General Secretary and Financial Secretary and money can be withdrawn after signatures of any two of the three aforesaid office bearers.
17. Property and Funds
Assets of Mathur Sabha will be utilised to achieve the objectives of the Society. The funds will not be misused for any private work of the office bearer. In case of dissolution of Mathur Sabha, all the funds will be used for the purpose as may be decided in the General Body Meeting.
All office bearers of Mathur Sabha will work without pay and allowances of any kind. Full amount of Life Memebership shall be kept in Fixed Depoist Account. Its interest shall be used for arranging functions and other day to day works.
Corpus fund generated by donations from the benevolent members and NRIs shall be kept in the Fixed Deposit Account and utilised for creating permanent assets for the Sabha.
Loan can be taken for specific purpose from the Fixed Deposit Account with the approval of the Executive Committee. However, the amount with interest is to be reimbursed with in a reasonable time specified by the Committee.
18. Auditing of Account
(i) The financial year of the Sabha shall be 1st April to 31st March.
(ii) The account of Mathur sabha will be audited once in a year by the auditor nominated by the General Body. The audited Report shall be presented by the General Secretary to the General Body for approval.
19. Vacant Posts
In case of resignation by any office bearer or vacancy caused by any other circumstances, the same will be filled up by nomination by the Executive Committee temporarily till the General Body meeting is held.
20. Constitutional Provisions
(i) It will be valid to make changes in the constitution of the Mathur Sabha which should be consistent with Section 12 of Rajasthan Societies Registration Act. 1958.
(ii) The Registrar of Co-operative Societies or his nominee is fully empowered to inspect the working of Mathur Sabha and make suggestions. As a sequel to his inspection/suggestions the office bearers of the Mathur Sabha will take suitable action to rectify the defects, if any.
(iii) The dissolution of Mathur Sabha, Jaipur if so required will be according to provisions laid down in Sections 13 and 14 of Rajasthan Societies Registration Act.
